Mobile App Terms of Use

1. About These Terms

These Mobile App Terms of Use supplement our general Terms of Use and apply specifically to the TravelCard mobile application for iOS and Android, operated by Travel Card Ltd. ("Travel Card", "we", "us", or "our").

By downloading, installing, or using the app, you agree to these terms, our general Terms of Use, and our Mobile App Privacy Policy. Where these terms conflict with the general Terms of Use on an app-specific matter, these terms control.

2. Licence to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, solely for authorised business use of the TravelCard service. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the app, except where such restriction is prohibited by law.

3. App Store Terms

Your use of the app is also subject to the terms of the store you obtained it from (the Apple App Store or Google Play). In the event of a conflict, those store terms govern your download and use of the app from that store.

For apps obtained through the Apple App Store, you acknowledge that:

• These terms are between you and Travel Card Ltd. only, not with Apple.
• Travel Card, not Apple, is solely responsible for the app and its content, support, and maintenance.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
• You comply with applicable third-party agreements and U.S. export and sanctions laws when using the app.

4. Account and Device Security

You are responsible for keeping your credentials, biometric unlock, and device secure, and for all activity that occurs under your account on the app. Enable your device's lock screen, keep your operating system up to date, and notify us promptly at legal@travelcard.io if you suspect unauthorised use.

5. Acceptable Use

The prohibited-conduct rules in Section 5 of our general Terms of Use apply to the app. In addition, you must not tamper with, interfere with, or circumvent the app's security. Using the app on a jailbroken, rooted, or otherwise compromised device may reduce its security and is at your own risk.

6. Updates and Availability

We may release updates, and some updates may be required for continued use. Your device or app store may download and install updates automatically. Availability and performance of the app may vary depending on your device, operating-system version, and network connection.

7. Push Notifications

By enabling notifications, you consent to receive push notifications related to your card and account activity. You can turn notifications off at any time in your device settings.

8. Third-Party Services

The app relies on third-party services (for example, maps and notification delivery), each subject to its own terms. We are not responsible for the availability, accuracy, or conduct of third-party services.

9. Intellectual Property

The app, its content, and all related intellectual property are owned by Travel Card Ltd. or its licensors. These terms grant you a licence to use the app only and do not transfer any ownership rights to you.

10. Termination

We may suspend or terminate your access to the app in accordance with our general Terms of Use. You may stop using the app at any time by uninstalling it. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) will continue to apply.

11. Disclaimers and Limitation of Liability

The app is provided "as is" and "as available" without warranties of any kind. The disclaimers and limitation of liability in Section 10 of our general Terms of Use apply in full to your use of the app.

12. Governing Law and Disputes

These terms are governed by the laws of the State of Israel, and the competent courts of Tel Aviv-Jaffa have exclusive jurisdiction. You waive any right to participate in class proceedings. If a Hebrew-language version of these terms exists, the Hebrew version prevails in the event of a legal conflict, consistent with Section 13 of our general Terms of Use.
